Tysean Malone was unconscious when police responded to his building on Kelly Parkway for smoke condition just before 1 a.m. on Monday, March 21, Bayonne Police Capt. Eric Amato said.
As officers arrived, they saw residents evacuating and a smoke billowing down a first-floor hallway in the building. They followed it to an apartment on the first floor.
Fearing someone was inside and in danger, officers entered the apartment and found Malone unconscious and a pan ablaze on the stove. Officers were able to bring him outside where he gained consciousness — and immediately became irate, police said.
Malone tried going back inside the apartment numerous times after being ordered not to, Amato said.
He was ultimately placed under arrest after he continued to interfere with the governmental function and became physically threatening to the officers. Malone was also found to be wanted on an arrest warrant issued out of the US Marshal Service in Arlington, VA. He was additionally charged with being a fugitive from justice.
Last August, police responded to Malone's apartment for the same reason, and found him asleep on the couch, NJ.com reports. While he and other residents were evacuated, authorities found crack cocaine and drug paraphernalia used to distribute drugs, police said. He was arrested and charged with the multiple drug offenses.
